NJAC case: Justice Dave heading 5-judge bench recuses himself
New Delhi, Apr 15 (IBNS): Justice AR Dave heading the five judge panel in the National Judicial Appointments Commission case has recused himself, reports said on Wednesday.
The Chief Justice of India will now have to set up a new bench to hear the case.
The bench was hearing the petitions challenging the validity of the Act to replace the two-decade-old collegium system of appointing judges.
According to reports, right at the beginning, senior advocate Fali S Nariman and advocate Mathew Nedumpara objected to Justice AR Dave's inclusion in the bench.
"Nariman said Justice Dave because of his number 2 position in seniority after CJI would be part of the 6-member commission under NJAC, which has been notified by the central government," The Times of India reported.
